Agreeing to these terms
These terms are an agreement between you and Bora Rota ("we", "us"). They apply to the website, the planner, the driver app and share links (together, the "service"). By creating an account or using the service, you agree to them and to our Privacy Policy.
If you use the service for a business or other organization, you're agreeing for it, and you confirm you're allowed to.
The service
Bora Rota helps you plan, optimize and drive routes with many stops. We keep improving it, so features may change. If we remove something important from a paid plan, we'll tell you first.
Your account
- You must be 18 or older to create an account.
- You sign in with a code or link sent to your email, so keep that inbox secure. You're responsible for what happens under your account.
- If you think someone else has access to your account, tell us right away at suporte@borarota.com.br.
- The person who creates an organization owns it. The owner chooses its plan, invites and removes members, and is responsible for how they use it. On plans without a team, only the owner can use the organization.
Plans and billing
- The Free plan costs nothing and holds up to 50 addresses. Paid plans and their limits are on the pricing page.
- Paid plans are billed in advance, every month or every six months, and renew automatically until you cancel. Prices are in Brazilian reais, and taxes are added at checkout where they apply.
- Polar processes our payments, and may appear on your receipt and card statement.
- A change to a plan that costs more a month takes effect right away, with a prorated charge for the rest of the period, unless it also shortens your billing period. Every other change, including cancelling, takes effect at the end of the period you've paid for.
- If we change our prices, we'll tell you at least 30 days before the new price applies to you, and it starts at your next renewal.
Cancellations and refunds
You can cancel a paid plan at any time from the planner. It stays active until the end of the period you've paid for and doesn't renew.
Right of withdrawal. If you signed up as a consumer, Brazil's Consumer Protection Code (art. 49) lets you withdraw within 7 days of signing up and get a full refund, without giving a reason.
Our refund policy. On top of that, for every customer, we'll issue a full refund if you ask within 72 hours of your payment and you've used less than 50% of your plan's address allowance.
To ask, email suporte@borarota.com.br or use the support form. Polar refunds you through the same payment method; on a credit card, it can take one or two statements to show up, depending on your bank.
Plan limits
Each plan limits how many addresses you can keep and add. If you're over a limit, for example after moving to a smaller plan, nothing is deleted, but you can't add addresses, plan routes, optimize, get directions or drive until you're back within it. You can still export and delete routes.
Your data
- What you put into Bora Rota, like addresses, notes and visit history, belongs to you. You give us permission to store, copy, process and use it to run, maintain and improve the service and develop our products. We may also use it in aggregated or anonymized form, so it doesn't identify you or your customers, for any purpose. Our Privacy Policy explains how we handle personal data.
- For your customers' data, your organization is the controller and we're the processor, as the LGPD defines them. It's up to you to have a legal basis for putting that data in the planner (usually, the delivery or service the customer asked for), to inform your customers where the law requires it, and to handle their requests.
- Anyone with a share link can see that route. Share links only with people you mean to, and turn a link off when it's no longer needed.
Acceptable use
Don't use the service to:
- break the law or anyone's rights;
- track, stalk or harass anyone;
- send spam through invitations or share links;
- get around plan limits, or overload, probe or disrupt the service;
- copy map, address or route data out of the service in bulk, or resell it;
- copy, resell or reverse-engineer the service, or use it to build a competing product.
We may suspend or close accounts that do, and we'll tell you why unless the law or someone's safety stops us.
Driving safely
Routes, drive times and distances are estimates from map data, which can be out of date or wrong. Always follow Brazil's traffic code (Código de Trânsito Brasileiro), road signs and conditions. Don't handle your phone while the vehicle is moving: holding or using a phone while driving is a very serious violation (infração gravíssima) under CTB art. 252. Pull over somewhere safe to mark a stop. You're responsible for how you and your drivers drive.
Other services
The service relies on other companies for things like maps and payments, and can open routes in Waze, Google Maps or Apple Maps. Their own terms apply when you use them, and we're not responsible for them.
Ending your account
You can stop using the service at any time, and cancel a paid plan from the planner. To delete your account and its data, email suporte@borarota.com.br.
We may suspend or end your access if you break these terms or don't pay. If we stop offering the service, we'll give you at least 30 days' notice so you can export your data.
Warranties
We work hard to keep Bora Rota accurate and available, but we provide it "as is" and "as available". To the extent the law allows, we don't promise that the service will be uninterrupted or error-free, that it fits a particular purpose, or that routes, drive times and addresses will always be accurate. This doesn't take away the guarantees Brazil's Consumer Protection Code gives consumers.
Limits on liability
To the extent the law allows, we aren't liable for indirect damages, lost profits, or lost revenue, data or goodwill. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim and R$500.
These limits don't apply where the law doesn't allow them, such as in cases of intent or gross negligence, and they don't reduce the rights of anyone who signed up as a consumer.
Claims about your use
If someone makes a claim or brings a lawsuit against us because of data you uploaded or because you used the service against these terms, you'll cover our reasonable costs of dealing with it.
Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant, we'll tell you by email or in the planner before it takes effect, and you can cancel if you don't agree. If you keep using the service after that, you accept the new terms.
Governing law
These terms are governed by the laws of Brazil. Any dispute about them will be decided by the courts where you're domiciled.
General
These terms, the Privacy Policy and the cancellation and refund rules above are the whole agreement between us about the service. If part of them can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up.
This is an English translation of our Portuguese terms. If the two differ, the Portuguese version prevails.
